Terms and conditions for using iCheck
By accessing and using iCheck, you agree to be bound by these Terms of Service and all applicable laws and regulations of the Federal Republic of Nigeria. If you do not agree with any of these terms, you are prohibited from using this service.
1. Definitions
In these Terms of Service:
- "iCheck," "we," "us," or "our" refers to Hustle 360 LTD, operating the iCheck platform
- "User," "you," or "your" refers to the individual or entity using our services
- "Platform" refers to the iCheck website, mobile applications, and all related services
- "Verification Services" refers to identity, employment, and address verification services
- "Personal Data" has the meaning ascribed in the Nigeria Data Protection Regulation (NDPR) 2019
2. Acceptance of Terms
These Terms of Service constitute a legally binding agreement between you and iCheck. By creating an account, accessing, or using our Platform, you:
- Acknowledge that you have read, understood, and agree to these Terms
- Represent that you are at least 18 years of age
- Represent that you have the legal capacity to enter into this agreement
- Agree to comply with all applicable Nigerian laws and regulations
3. Service Description
3.1 Verification Services
iCheck provides:
- Identity Verification: Verification using National Identification Number (NIN) through NIMC integration
- Employment Verification: Verification of employment history with previous and current employers
- Address Verification: Verification of residential address history
- Verification Score: Calculation and display of trustworthiness rating based on verified information
- Verification Reports: Generation of reports for authorized third parties
3.2 Platform Features
- Secure document storage and management
- Dashboard for tracking verification status
- Notification system for updates
- Reward points program
- Access control for sharing verification reports
4. User Registration and Account
4.1 Account Creation
To use iCheck, you must:
- Provide accurate, current, and complete information
- Have a valid Nigerian National Identification Number (NIN)
- Provide a valid email address and phone number
- Create a secure password
- Agree to our Privacy Policy
4.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
- Ensuring your contact information is current
4.3 Account Termination
We may suspend or terminate your account if:
- You violate these Terms of Service
- You provide false or misleading information
- Your account is used for fraudulent activities
- You fail to respond to verification requests
- Required by law or regulatory authorities
5. User Obligations and Prohibited Conduct
5.1 Permitted Use
You may use iCheck only for:
- Personal identity verification purposes
- Building and maintaining your verification profile
- Sharing verification reports with authorized parties
- Employment and rental application purposes
5.2 Prohibited Activities
You must NOT:
- Provide false, inaccurate, or misleading information
- Impersonate another person or entity
- Use another person's NIN or identity documents
- Upload forged or fraudulent documents
- Attempt to circumvent verification processes
- Hack, exploit, or compromise the Platform's security
- Use automated systems (bots, scrapers) without authorization
- Reverse engineer or decompile the Platform
- Resell or redistribute our services without permission
- Violate any applicable Nigerian laws or regulations
5.3 Consequences of Prohibited Conduct
Violation of these terms may result in:
- Immediate account suspension or termination
- Legal action under Nigerian law
- Reporting to law enforcement authorities
- Referral to NITDA for data protection violations
- Civil and criminal liability
6. Verification Process
6.1 Information Accuracy
You warrant that:
- All information provided is true, accurate, and complete
- Documents uploaded are genuine and unaltered
- You have the right to use and share the documents provided
- Employment and address information can be independently verified
6.2 Third-Party Verification
You authorize iCheck to:
- Contact your employers for employment verification
- Contact your landlords for address verification
- Verify your identity through NIMC
- Store verification responses from third parties
6.3 Verification Timeline
- Identity Verification: Instant to 24 hours
- Employment Verification: 3-7 business days
- Address Verification: 3-7 business days
- Delays may occur due to third-party response times
6.4 Verification Rejection
Verifications may be rejected if:
- Information cannot be confirmed by third parties
- Documents appear fraudulent or altered
- Contact persons cannot be reached
- Information conflicts with official records
7. Fees and Payment
7.1 Service Fees
iCheck currently operates on a freemium model:
- Basic Verification: Free (identity, employment, address verification)
- Premium Features: May require payment (to be announced)
- Verification Reports: Free for personal use; may charge for third-party access
7.2 Payment Terms
When paid features become available:
- All fees are in Nigerian Naira (NGN)
- Payments processed through authorized Nigerian payment gateways
- Fees are non-refundable except as required by law
- We reserve the right to change fees with 30 days' notice
8. Intellectual Property Rights
8.1 Platform Ownership
All rights, title, and interest in the iCheck Platform, including software, designs, logos, trademarks, and content, are owned by Hustle 360 LTD and protected by Nigerian and international intellectual property laws.
8.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to:
- Access and use the Platform for personal purposes
- Download your verification reports
- Share your verification status with authorized parties
8.3 User Content
You retain ownership of documents and information you upload, but you grant us a license to:
- Store and process your information for verification purposes
- Display your verification status to authorized third parties
- Use anonymized data for platform improvement and analytics
9. Data Protection and Privacy
Your use of iCheck is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

- We comply with the Nigeria Data Protection Regulation (NDPR) 2019
- Your data is stored securely in Nigeria or ECOWAS-approved locations
- You have rights to access, correct, and delete your personal data
- We implement industry-standard security measures
10. Disclaimers and Limitations of Liability
10.1 Service "As Is"
iCheck is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
10.2 No Guarantee of Accuracy
While we strive for accuracy, we do not guarantee:
- Complete accuracy of verification results
- That third parties will respond to verification requests
- That the Platform will be error-free or uninterrupted
- That verification will result in employment or rental approval
10.3 Limitation of Liability
To the maximum extent permitted by Nigerian law:
- iCheck shall not be liable for indirect, incidental, special, or consequential damages
- Our total liability shall not exceed the fees paid by you (if any) in the 12 months preceding the claim
- We are not liable for decisions made by third parties based on your verification status
- We are not liable for unauthorized access to your account due to your negligence
10.4 Force Majeure
We are not liable for failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, strikes, government action, internet failures, or NIMC system outages.
11. Indemnification
You agree to indemnify, defend, and hold harmless iCheck, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your violation of these Terms
- Your violation of any rights of third parties
- Your use or misuse of the Platform
- False or fraudulent information provided by you
- Your violation of Nigerian laws or regulations
12. Dispute Resolution
12.1 Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be interpreted in accordance with Nigerian law.
12.2 Arbitration
Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to arbitration under the Arbitration and Conciliation Act of Nigeria.
12.3 Jurisdiction
If arbitration is not successful, disputes shall be resolved in the courts of Lagos State, Nigeria, and you consent to the exclusive jurisdiction of such courts.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective:
- Immediately for non-material changes
- 30 days after notice for material changes
We will notify you of changes via:
- Email to your registered address
- Prominent notice on the Platform
- In-app notifications
Continued use after changes constitutes acceptance of modified Terms.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable by a Nigerian court, the remaining provisions shall continue in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and iCheck regarding use of the Platform and supersede all prior agreements.
